The
Municipal Court is a local court created by state law, whose territory
is confined to the municipality in which it is located. Practice and procedures
are governed by New Jersey Court rules.
Pennington Borough is one
of thirteen Municipal Courts in Mercer County. Each municipality appoints
its own Municipal Court Judge. Other court staff includes the Court
Administrator and Court Recording Clerk.
The Municipal Court receives
and files all complaints signed by law enforcement officers and private
citizens for violations which occur within Pennington Borough. Types
of cases include violations of state traffic laws, petty disorderly
and disorderly persons offenses, and Borough Ordinance violations.
The Court is responsible
for the scheduling of cases, collection of fines, record keeping and
report dispositions to a variety of agencies, some of which include
the New Jersey State Police and the Division of Motor Vehicles.
Court sessions are open proceedings
and may be viewed by the public. There is no jury in a Municipal court
proceeding. Testimony is taken from the complainant, defendant, and
any witnesses and a decision is rendered by the judge based on the facts
presented and the law.
